Personal laws must comply with fundamental rights: Arun Jaitley

The Narendra Modi led government believes that ā€œpersonal laws must comply with fundamental rightsā€, Finance Minister Arun Jaitley has said, defending the Centre's opposition to the practice of ā€˜triple talaqā€™ among Muslims.

The governmentā€™s view is clear. Personal laws have to be constitutionally compliant, and the institution of triple talaq, therefore, will have to be judged on the yardstick of equality and the right to live with dignity,ā€ Jaitley wrote in a signed article on Sunday.

ā€œGovernments in the past have shied from taking a categorical stand that personal laws must comply with Fundamental Rights. The present government has taken a clear position,ā€ he said.

The finance minister also sought to differentiate triple talaq from the larger issue of Uniform Civil Code. ā€œAs of today, the issue before the Supreme Court is only with regard to the constitutional validity of triple talaq,ā€ he wrote.

Hearing petitions on the validity of triple talaq and polygamy in the Muslim community, a Supreme Court bench headed by Chief Justice of India TS Thakur had last month asked the government to convey its stand on the issue.

The next hearing is slated for October 18. ā€œOn more than one occasion, the Supreme Court has enquired from the government its stand on the issue,ā€ Jaitley wrote on Sunday

Governments have repeatedly told both the court and Parliament that personal laws are ordinarily amended after detailed consultations with affected stakeholders.

Civil code debate
He said the law commissionā€™s exercise on Uniform Civil Code was an ā€œacademic exerciseā€ on whether personal laws should be constitutionally compliant as a continuation of the debate on this issue.

ā€œThe academic debate with regard to the Uniform Civil Code can go on before the law commission. The question to be answered is that assuming that each community has its separate personal law, should not those personal laws be constitutionally compliant?ā€ Jaitley said

Irrespective of whether the Uniform Civil Code is today possible or otherwise, a pertinent question arises with regard to reforms within the personal laws of various communities,ā€ he wrote.

ā€œReforming the personal laws, even if there is no uniformity, is an ongoing process.ā€ An eminent lawyer himself, Jaitley wrote, ā€œWith passage of time several provisions became obsolete, archaic and even got rusted. Governments, legislatures and communities have to respond to the need for a change.ā€

Budget: Startup sector gets new Fund of Funds, FM to allocate Rs 10K cr

  The Indian startup sector received a boost with Finance Minister Nirmala Sitharaman announcing the establishment of a new fund of funds (FoF) in the Budget 2025. The minister unveiled a fresh FoF with an expanded scope, allocating Rs 10,000 crore. RBI to weigh growth slowdown, inflation at its MPC meeting this December

  Despite GDP growth declining to 5.4 per cent in the Julyā€“September quarter, the Reserve Bank of Indiaā€™s (RBI) six-member monetary policy committee (MPC) is expected to maintain the current repo rate during its review meeting this week, according to a Business Standard survey of 10 respondents. Among the respondents, only IDFC First Bank forecast a 25-basis-point (bps) reduction in the repo rate. Since May 2022, the RBI has raised the repo rate by 250 bps to 6.5 per cent as of February 2023 and has held it steady across the last 10 policy reviews. The latest GDP figures, published on Friday (November 29), showed that growth for Q2 FY25 slowed to 5.4 per cent year-on-year, down from 6.7 per cent in Q1. Most survey participants suggested that the RBI might revise its growth and inflation projections for the financial year.
