After section 80-IB of the Income-tax Act, section 80-IBA shall be inserted with effect from the 1st day of April, 2017. The section was inserted by Finance Act, 2016.

Where the gross total income of an assessee includes any profits and gains derived from the business of developing and building housing projects, there shall, subject to the provisions of this section, be allowed, a deduction of an amount equal to hundred per cent of the profits and gains derived from such business.
Approval of Project between : 01/06/2016 to 31/03/2019
Project Should be Completed within 3 Year of Approval. If approval for more than 1 time than 3 year from first approval.Project was deemed to be Completed when a certificate of completion of project as a whole is obtained in writing from the competent authority.

Where a residential unit in the housing project is allotted to an individual, no other residential unit in the housing project shall be allotted to the individual or the spouse or the minor children of such individual.

The Assessee has to maintain separate books of account in respect of housing project.

Where the housing project is not completed within the period three year from date of approval, in respect of which a deduction has been claimed and allowed under section 80-IBA, the total amount of deduction so claimed and allowed in one or more previous years, shall be deemed to be the income of the assessee chargeable under the head ā€œProfits and gains of business or professionā€ of the previous year in which the period for  completion so expires.

It should also be noted that Changes in Service Tax also made as under :

Services by way of construction etc. in respect of-

(i) housing projects under Housing For All (HFA) (Urban) Mission/Pradhan Mantri Awas Yojana (PMAY);

(ii) low cost houses up to a carpet area of 60 square metres in a housing project under ā€œAffordable housing in Partnershipā€ component of PMAY,

(iii) low cost houses up to a carpet area of 60 square metres in a housing project under any housing scheme of the State Government,

are being exempted from Service Tax with effect from 1st March, 2016.

Meaning of Other Terminology :

(a) ā€œbuilt-up areaā€ means the inner measurements of the residential unit at the floor level, including projections and balconies, as increased by the thickness of the walls, but does not include the common areas shared with other residential units, including any open terrace so shared;

(b) ā€œcompetent authorityā€ means the authority empowered by the Central Government;

(c) ā€œfloor area ratioā€ means the quotient obtained by dividing the total covered area of plinth area on all the floors by the area of the plot of land;

(d) ā€œhousing projectā€ means a project consisting predominantly of dwelling units with such other facilities and amenities as the competent authority may specify subject to the provisions of this section;

(e) ā€œresidential unitā€ means an independent housing unit with separate facilities for living, cooking and sanitary requirements, distinctly separated from other residential units within the building, which is directly accessible from an outer door or through and interior door in a shared hallway and not by walking through the living space of another household.

Budget: Startup sector gets new Fund of Funds, FM to allocate Rs 10K cr

  The Indian startup sector received a boost with Finance Minister Nirmala Sitharaman announcing the establishment of a new fund of funds (FoF) in the Budget 2025. The minister unveiled a fresh FoF with an expanded scope, allocating Rs 10,000 crore. The initial fund of funds announced by the government with an investment of Rs 10,000 crore successfully catalysed commitments worth Rs 91,000 crore, the minister said.   ā€œThe renewal of the Rs 10,000 crore commitment to the Fund of Funds for alternative investment funds (AIFs) is a significant step forward for the Indian startup and investment ecosystem. RBI to weigh growth slowdown, inflation at its MPC meeting this December

  Despite GDP growth declining to 5.4 per cent in the Julyā€“September quarter, the Reserve Bank of Indiaā€™s (RBI) six-member monetary policy committee (MPC) is expected to maintain the current repo rate during its review meeting this week, according to a Business Standard survey of 10 respondents. Among the respondents, only IDFC First Bank forecast a 25-basis-point (bps) reduction in the repo rate. Since May 2022, the RBI has raised the repo rate by 250 bps to 6.5 per cent as of February 2023 and has held it steady across the last 10 policy reviews. The latest GDP figures, published on Friday (November 29), showed that growth for Q2 FY25 slowed to 5.4 per cent year-on-year, down from 6.7 per cent in Q1. Most survey participants suggested that the RBI might revise its growth and inflation projections for the financial year.
